Mr Bruce Fein, international counsel to Mazi Nnamdi Kanu, weekend, described the ruling of the Supreme Court on Friday ordering the trial of Kanu as ‘wickedly’.
Our correspondent reports that the Apex Court held that Kanu should undergo trial on treason charges preferred against him by the federal government despite admitting that the process of his arrest from Kenya and his subsequent deportation to Nigeria was faulty.
Fein, who reacted through his X handle, wrote, “The Nigerian Supreme Court has wickedly made the law an instrument of injustice. It accepts MNK was kidnapped, tortured, and renditioned by Nigeria but lets the government profit from diabolical crimes with impunity. It has aided and abetted lawlessness. Execration is warranted.”
A part of Friday’s judgement as prepared by Justice J. Garba, and read by Justice Agim Emmanuel, held that, “There is no legislation that provides that a trial court will not have jurisdiction where a prosecution violates a person’s right. Certainly, we decided not to go with the Court of Appeal decision.”
He however said the apex court strongly condemned what the prosecution did, adding that Nigeria must protect its image through adherence to International and local law.
Quoting him, “The Nigerian law has not stated that the court should decline jurisdiction from trying a case even if law enforcement has violated the rights of a person.”
The Appeal Court earlier discharged and acquitted Kanu on the ground that the manner he was brought to Nigeria from Kenya amounted to an abuse of international laws.
