The Makurdi division of the Federal High Court has dismissed the suit filed by a guber aspirant of the APC in Benue State, Prof Terhemba Shija, which prayed the court to nullify the declaration of Rev Fr Hyacinth Iormem Alia as the party’s candidate.
The court president over by Justice Hassan Diko, Thursday, upheld the preliminary objection raised by APC and Fr Alia, adding that Shija had no basis of instituting the suit having admitted in his originating summons that he did not participate in the primaries held May 22, 2022.
The court held that Benue APC conducted a valid primary election in the eleven (11) local governments that Prof Shija was challenging.
The court therefore dismissed the suit for lack of substantial evidence.
Aside Shija’s suit against Fr Alia, the Catholic priest-turned politician is still contending with suits challenging his emergence from the Peoples Democratic Party (PDP), Sen Barnabas Gemade and Michael Kaase Aõndonakaa (SAN).
