NYSC: Gov Mbah Prays Court to Dismiss NYSC’s Objection To His N20bn Suit

Governor Peter Mbah of Enugu State has prayed a Federal High Court sitting in Abuja to dismiss a preliminary objection filed by the National Youth Service Corps (NYSC) against his N20 billion suit over alleged certificate forgery.

Christopher Oshomegie, SAN, Mbah’s counsel, made the prayers when the matter came up before Justice Inyang Ekwo on Tuesday.

Oshomegie urged Justice Ekwo to dismiss the objection on the grounds that sections cited in the NYSC Act were not applicable in the instant suit.

He posited that a counter-affidavit and a written address had been filed in response to the preliminary objection.

Quoting him, “We adopt our written address as our oral argument to the preliminary objection in urging my lord to dismiss their application.”

The counsel for the NYSC, Aminu Sadauki, earlier told the court that the matter was fixed for Tuesday for the hearing of their objection.

Sadauki, who adopted the objection, argued that Mbah contravened the NYSC Act in the institution of the suit.

Our correspondent reports that Justice Ekwo adjourned the matter to September 22 for ruling.
